O-1: Individuals with Extraordinary Ability or Achievement

The O visa is a non-immigrant, temporary employment visa granted by the United States to individuals who possess extraordinary ability or achievement in specific fields, including sciences, education, and business. To qualify for an O-1 visa, a foreign national must demonstrate sustained national or international acclaim and be coming to the U.S. to continue work in their area of expertise. 

The initial visa may be granted for up to three year, with extensions available in one-year increments as long as the individual continues to meet eligibility requirements and the need for their expertise persists. Each extension requires filing Form I-129 along with documentation supporting the continued need for their work. This visa is commonly granted to tenure-track professors and research scientists, and other highly accomplished professionals. 

O-1 visa holders can only work during the validity period of their approved petition.  

Note: Dependents of O-1 visa holders (classified as O-3) may accompany the principal visa holder but are not authorized to work in the United States without separate valid and current work authorization.
