L-2: Dependent Spouse and Children of L-1 Visa Holders
This visa allows the spouse of a qualified L-1 visa holder to enter and reside in the United States. The spouse of an L-1 visa holder can work in the U.S. without needing a separate work permit, provided their Form I-94 is annotated with the L-2S designation. The spouse’s I-94 form showing their L-2S status serves as evidence of work authorization. The L-2 visa is directly tied to the L-1 visa holder’s status, meaning if the L-1 visa holder loses their status, the spouse’s visa becomes invalid too.
Note: Only unmarried children under the age of 21 can accompany the L-1 visa holder to the U.S. on an L-2 visa. Children on L-2 visas can attend public or private school through college. However, they are not authorized to work in the United States.
An L-2 visa is valid for as long as the L-1 visa is valid, which can be up to five to seven years depending on the type of L-1 visa. This visa is also eligible for extensions as long as the L-1 visa holder is eligible for extensions. Extensions are typically granted in two-year increments.
